Terms of Service
Effective date: . If you need an older version, contact contact@esimsupra.com.
By using eSIMSupra, you agree to these Terms of Service. Please read them carefully.
1. Parties and contact
eSIMSupra (the "Service", "we", "us", "our") is operated by the legal entity trading as eSIMSupra, contactable at contact@esimsupra.com. "You" means the adult purchaser or user of a plan.
Operator note: replace with your registered company name, address, jurisdiction of incorporation, and company number before commercial launch.
2. Eligibility
You must be at least 18 years old (or the age of majority in your country of residence if higher) to purchase a plan. By placing an order you confirm you meet this requirement and that you have legal capacity to contract.
1. Service
eSIMSupra provides prepaid eSIM data plans delivered digitally. Availability and coverage vary by destination.
Plan availability, included data, validity, speed, and supported carriers are listed on each plan page and may change over time. Network coverage is provided as-is and depends on local carrier infrastructure, your device's band support, and regional conditions beyond our control.
4. Orders, pricing, and taxes
- Prices are displayed in USD by default and in your local currency when supported. The final charge is made in USD by our payment processor; bank conversion and FX spreads are outside our control.
- Taxes, VAT, or GST, where applicable, are either included in the displayed price or added at checkout as disclosed to you before you confirm payment.
- An order becomes binding when we send you the order confirmation email. We reserve the right to refuse or cancel an order if it appears fraudulent, violates sanctions lists, or is placed from a blocked jurisdiction.
2. Delivery & Activation
eSIMs are delivered via email after payment. Activation requires a compatible, unlocked device and an internet connection.
3. Refunds
Refund eligibility is governed by our Refund Policy, which forms part of these Terms. Where EU/UK consumer law grants a 14-day right of withdrawal for digital goods, you acknowledge that activating the eSIM profile begins performance of the service and therefore extinguishes that right for the activated plan, in line with Article 16(m) of Directive 2011/83/EU.
4. Acceptable Use
Do not use the service for unlawful or abusive activities. We reserve the right to suspend service for violations.
8. Intellectual property
The website, brand, logo, site copy, design, and software are the intellectual property of the operator of eSIMSupra and its licensors. You receive a limited, personal, non-exclusive, non-transferable licence to use the service. Nothing in these Terms transfers ownership of any intellectual property.
9. Warranties and disclaimers
To the maximum extent permitted by applicable law, the service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory β including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that coverage, speed, or availability will be uninterrupted or error-free. Nothing in this section limits any warranty that cannot lawfully be excluded in your jurisdiction.
5. Limitation of Liability
To the maximum extent permitted by applicable law, our aggregate liability to you for any claim arising from the service is limited to the total amount you paid for the specific plan that gave rise to the claim within the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, missed bookings, roaming charges on your home carrier, or travel-plan disruption. Nothing in this section limits liability that cannot lawfully be limited, such as for death, personal injury caused by our negligence, or fraud.
11. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the operating entity is registered, without regard to conflict-of-law rules. Any dispute will first be attempted to be resolved by good-faith negotiation between you and us for at least 30 days. If that fails, disputes will be resolved by the courts of that jurisdiction, except where mandatory local consumer-protection law grants you a right to your local court. EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Operator note: specify the exact governing law and forum (e.g. "laws of England and Wales, courts of London" or "laws of Delaware, state and federal courts of Delaware") before commercial launch.
12. Termination
We may suspend or terminate the service or your access to any part of it at any time for breach of these Terms, legal compulsion, or security reasons. Sections that by their nature should survive termination (intellectual property, warranties, liability, governing law) will survive.
6. Updates
We may update these terms from time to time. Continued use indicates acceptance of the updated terms.
14. Miscellaneous
- Severability. If any part of these Terms is held unenforceable, the rest remains in effect.
- Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, form the entire agreement between you and us.
- No waiver. Our failure to enforce a provision does not waive our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for events beyond our reasonable control (outages at upstream carriers, natural disasters, regulatory action, acts of war).
